CONFEDERATION CIRCULAR ON STRIKE BALLOT & 15 CHARTER OF DEMANDS

Dear Comrades,
You are well aware of the fact that Civil status and all benefits at par with regular departmental employees  to the Gramin Dak Sevaks can be achieved except Departmentalization of BOs & Regularization of GDS.  
For the last few decades, we had the experience of 5 Pay committees, except Justice Talwar Committee,  all other, with the influence of officialdom  negated the legitimate benefits of GDS, except few,  with the series of struggles conducted so for. 
Again and again the Department is trying to suppress and diluting the status of GDS in the Department with the stringent modifications in  non-statutory rules from Conduct &Service Rules to Engagement Rules. The recent One Man Committee is a replica of the attitude of bureaucrats.
It should not be continued further and all with one determination ie., Departmentalization & Regularization, moving ahead with united struggles for the cause of GDS.
You might have known that the GDS demand has been given such an importance in the JCA formed with Railway & Defense Unions with Confederation for further struggles among  the demands of all Central Govt Employees.
 The NFPE along with AIPEU GDS (NFPE) is on the move to include GDS issues in the purview of 7th Central Pay Commission. Besides, NFPE & Confederation of Central Govt Employees and Workers conducted many joint struggles with GDS demands including the recent strike on 12-12-2012.
A phase of action came before us, which needs an elaborate discussion on the struggles and strikes on various issues affecting the basic rights of the employee’s sections and working class. Except industrial action, the Govt is allowing for conciliation of the demands and bargaining.
Now, the choice has to be taken by all GDS to prepare for an industrial action along with the entirety of Central Govt Employees by taking appropriate decision on strike ballot forwarded by the Confederation.
Your decision is in favour of strike – tick “YES” 
Hopefully we can not expect “NO” from any GDS.......!!!

NFPE WESTERN ZONE STUDY CAMP

The western Zone Study Camp of NFPE conducted on 25th & 26th August 2013 at Pushkar (Rajasthan) was a great success. About 220 delegates from Himachal Pradesh, Haryana, Punjab, Delhi, Rajasthan and Jammu & Kashmir attended the camp. Some delegates from Gujarat also attended. (Detailed report placed in the website).

NORTHERN ZONE STUDY CAMP

Northern Zone Study Camp will be conducted at Ghaziabad (Uttar Pradesh) on 21st & 22nd September 2013. Delegates from Uttar Pradesh & Uttarakhand will attend the camp (For detailed circular see website).

NFPE FEDERAL SECRETARIAT DECISIONS

Federal Secretariat of NFPE met at Pushkar (Rajasthan) on 26.08.2013. The Secretariat took the following important decisions.

(i)  Confederation Campaign programmes:- The Federal secretariat decided that NFPE should play a leading role in implementing the campaign programmes of Confederation. Relay Mass Dharna (September 2ndto 7th), state and District level convention and the strike ballot (September 25, 26, 27) should be made a grand success.

(ii)   Federal Secretariat decided to organise the strike ballot in a most effective manner. Intensive campaign should be undertaken at Branch/Divisional/Circle level. The model appeal and ballot is enclosed with the confederation circular. All employees including GDS may be contacted and requested to participate in the strike ballot (Full details available in the Confederation circular)

(iii)   Confederation All India Trade Union Education Camp –

(V) Diamond Jubilee celebrations of NFPE & 109th year of Postal Trade Union movement:

As decided in the Hyderabad Federal Council, the Federal Secretariat decided to commence the celebrations of the Diamond Jubilee of NFPE and 109th year of the Postal Trade Union movement on 24th November 2013. The one year long celebrations shall end on 24th November 2014. On 24th November 2013, the inaugural ceremony of the celebrations will be held at New Delhi. Further details will be decided later.

(VI) AIPEU-GDS (NFPE) Parliament march on 11th December 2013

AIPEU-GDS (NFPE) has decided to conduct a massive Parliament March on 11th December 2013. All affiliated Unions of NFPE are requested to extend full support and participation to make the GDS Parliament March a grand success.

The AIC and CWCs of the following unions will be held on the dates and places noted against each:

    (a)   AIC of R4 Union – 2013 8th, 9th and 10th November at Pune (Maharashtra)
    (b)   CWC of AIPAEA – 2013 October 28, 29, 30 at Lucknow (Uttar Pradesh)
    (c)    CWC of Admn Union on 2013 September 23 and 24 at Ranchi (Jharkhand)
    (d)   CWC of P3 Union will be held at Guwahati (Assam) on 2013 December 14 and 15
   (e)  AIC of P4 Union – AIC of P4 Union will be held at Cuttuck (Orissa) on 2013 December 29th, 30th & 31st.
    (f) CWC of AIPEU-GDS (NFPE) will be held at Kolkata (West Bengal) on 26th October 2013.
   (g)   CWC of R3 Union will be held at Puri (Orissa) on 8th & 9th December 2013.

(VII) ALL INDIA CAMPAIGN JATHA

The Federal Secretariat has decided to explore the possibility of organizing five or Six All India Vehicle Campagin Jathas of NFPE from different part of the country, each Jatha covering 3 or 4 states, before 2014 January. All Circle Secretaries/Divisional Secretaries are requested to intimate their opinion about organizing All India Jathas against the policies of the Government of India.  Each Jatha is to be given grand reception at all important cities. Final decision will be taken by the next Federal Secretariat after reviewing the feedback received from Circles/Divisions.

GDS DEMANDS ALSO INCLUDED IN THE AGENDA OF NATIONAL COUNCIL (JCM) MEETING

Agenda for next meeting of the JCM National Council has been finalized on 27.08.2013 in consultation with DOP&T.
Twelve demands raised by Confederation in the charter of demands are included. (including GDS employees demand) 
Next meeting of National Council JCM is expected by the end of October 2013.

Sub:- Convening the 47th National Council meeting — regarding.

Dear Sir,
The last meeting of the National Council (46th) was held on 15.5.2010. It is now more than 38 months that the Council met. As per the provisions of the Constitution of the National Council it ought to have been convened once in four months. The non-convening of the meeting has resulted in inordinate delay even in addressing the demands / issues / problems of the employees giving rise to discontent, frustration, anger and agitation.

We had send a few items for the inclusion in the agenda of the National Council vide our letter No. NC-JCM-2010/47th N.C. Meeting dated 17.1.2012. The passage of time without any meeting has resulted in certain issues gaining importance and the settlement of which cannot brook any delay.

We send herewith 12 such items for inclusion in the agenda as per the discussion with JS (E), some of the Staff Side members had a few days back.

This apart, the National Anomaly Committee which was set up in the wake of acceptance of 6th CPC recommendations is yet to conclude its business. There are issues in the agenda of National Anomaly Committee, which was not subjected to discussion even once. The MACP related matters have not also been brought back to the NAC to reach its logical conclusions.

We request you to kindly convene the National Council meeting, meeting of NAC on a date mutually convenient prefaralaly in the months of August itself.

CHARTER OF DEMANDS

1. Revise the wages of the Central Government employees including Gramin Dak Sewaks with effect from 1.1.2011 and every five years thereafter by setting up the 7th CPC.

2. Merge DA with pay for all purposes with effect from. 1.1.2011 including for Gramin Dak Sewaks.

3. Remove restriction imposed on compassionate appointments and the discrimination on such  appointments between the Railway workers and other Central Govt. employees.

4. (a) Departmentalise all Grameen Dak Sewaks and grant-them all benefits of regular employees; End Bonus discrimination and enhance bonus ceiling to 3500/-; withdraw open market recruitment inPostman / MTS cadre; Revise cash handling norms; Grant full protection of TRCA; Grant Time Bound Promotion and Medical Reimbursement facility etc,

(b) Regularise the daily rated, contingent, casual workers and introduce a permanent scheme for periodical regularization. Pending regularization, provide them with pro-rata salary at 6th CPC rates.

5. (a) Revive the functioning of the JCM. Convene the meeting of the Departmental Councils in all Ministries/Departments. Settle the anomalies raised in the National Anomaly Committee as also in the Departmental Anomaly Committees. Hold National Council meetings as specified in the JCM constitution. (b) Remove the anomalies in the MACP Scheme.(c) Grant recognition to all Associations/Federations, which have complied with the formalities and conditions stipulated in the CCS(RSA) Rules.

6. Fill up all vacant posts and creates posts n functional requirements.

7.Stop downsizing outsourcing, contractorization, corporatization and privatisation of Governmental functions.

8. (a) Stop the proposal to introduce the productivity linked wage system; (b) discard the performance related pay structure; (c) introduce PLB in all Departments; (d) remove the ceiling on emoluments for bonus computation.

9. Revise the OTA, Night duty allowance and clothing rates.

10. Implement all arbitration awards;

11. Grant Five promotions to all employees as is provided for in the case of Group A services.

12. (a) Withdraw the PFRDA Bill. (b) Rescind the decision to allow FDI in pension sector;(c) Scrap the new contributory pension scheme (d) Extend the existing statutory defined pension scheme to all Central Govt. employees irrespective of their date of entry in Government service.

WESTERN ZONE STUDY CAMP - PUSHKAR (RAJASTHAN)

N F P E Western zone study camp has commenced today (25th) in Pharik Samskritik Bhawan, Pushkar, Rajasthan. About 250 Delegates from NFPE unions of Rajasthan, Gujrat, Haryana, Himachal Pradesh, Punjab, Delhi Circles including GDS were participated in the study camp.

National flag hoisted by Com.M.Krishnan, Secretary General, CCGEW & NFPE and AIPEU flag hoisted by Com.Iswar Singh Dabas, General Secretary, P-IV.

Com.H.P.Diwakar, General Secretary, Reception Committee welcomed all the leaders and invitees to the session and Com. Giriraj Singh, President, NFPE as Chairperson for today’s session.

The New Circle Welfare Fund Scheme for GDS

The Directorate has circulated a draft copy of the proposed Scheme on Circle Welfare Fund for GDS. We made a careful study of the scheme. It is found that the contributory CWF Scheme which now exists in some circles is more advantageous and beneficial than the present proposed scheme. 

For example, in Kerala circle, the financial assistance being granted towards the medical treatment to GDS goes up to 1 lakh and there is no restriction in the claims in respect of all major diseases and also in respect of other welfare measures, it seems with more benefits positively than the present scheme proposed by the department.

More over the maternity grant, death relief, scholarship for children of GDS etc., are being granted already from the Welfare Fund of the Dept irrespective of the contribution made by the GDS. Except grant of loan up to Rs50000 that too for a limited three purposes like construction of room for BO, purchase of computers and motor cycle etc, nothing new in the proposal.

The new proposal is nothing but to manage the welfare grants hitherto granted by the Govt from the welfare grant and from the contribution of the GDS. The employee’s contribution is proposed as Rs.240 p.a and the Dept’s contribution is fixed as Rs.100 p.a.  only. The amount proposed for certain welfare grants are also very meager and reflected the same rates as prevailing today. 

The freezing of benefits and refund for penalties imposed in cases viz., removal, dismissal and resignation etc., is the retrograde provision even though they contributed for the scheme.

Taking into consideration of many other facts, this union is dissatisfied and disappointed on the proposed scheme. However, for those circles where no such scheme is in existence, it may not be ruled out the benefits. 

There may be many changes required in the proposed scheme and the rates prescribed for all the welfare measures are inadequate and requires further revision. Otherwise the scheme will be half-baked and the desired results may not reach the most exploited GDS.


This union is requesting the Department to modify the scheme after studying the schemes now existing in many Circles and make it more attractive and beneficial to the GDS.

In addition all General Secretaries of the above unions shall attend the camp.

    Circle Secretaries are requested to select the delegates of their unions immediately and instruct them to book the up and down tickets without any further delay.  They should reach Ghaziabad  before 08-30 A M on 21st and   22nd September ,2013. They can leave the camp only after 6 PM on 22nd September 2013.  Maximum lady comrades may be included as delegates. The names of the delegates attending the camp should be intimated to the respective General Secretaries before 31st Aug 2013. Programme will be intimated separately.

            A Seminar on Postal Services will be held in connection with Study Camp. Senior Officers of the Department of Posts will address the Seminar. Special casual leave will be granted to the delegates for attending Seminar. Details will follow.

 Delegate fee per head is fixed as Rs 600/- (Rs six hundred only).

            All General Secretaries are requested to instruct their circle Secretaries suitably to immediate follow up action.
