AIPEU-GDS :: ODISHA CIRCLE :: 4th BIENNIAL CIRCLE CONFERENCE - 23-02-2020 - CUTTACK CITY

Attended the 4 th Biennial circle Conference of AIPEU- GDS , Odisha Circle branch at Cuttack GPO being the General Secretary of CCGEWCoC and AIPRPA Odisha State committee and as Former Leader,RJCM(Staff side),Odisha Circle and inaugurated the Conference.

Among other leaders Com.MCS Rao,C.S.,P -4, Com.Bishnu Pd Das,D S, P -3 Cuttack City Division are attended. Total 17 Divisions attended in the conference out of 19 Divisions of the circle.The conference was held in the eve of retirement of Com Nirmal Singh, Circle Secretary of 22 years who will superannuated from the Government service and will discharged from GDS packer post w.e..f.09.03.2020, a few days ahead. The retired GDS officials Sri H k Sahoo,N  C Routray, K Ch Dash, and other three were felicitated .Com N C  Singh was felicitated by Com K C Natia. 

Com.Jogesh Ch Sahoo, Com.Ashok Ku Panda and Com. Niranjan Tripathy are unanimously elected as President, Circle Secretary and Treasure of the circle union for the next two years. About 100 Comrades, delegates, visitors attended the conference and the conference ended with vote of thanks to the chair.The  Conference ended with rousing slogans.

GDS Service is Government Service and all GDS to Postman or MTS after 1.1.2004 should not be under NPS automatically - Advocate Arun argued

== As I was in Chennai CAT to hear the arguments on Pre-2006 Pensioners case, I had the occasion to observe a GDS to Postman placed under NPS case argued by Advocate Arun. The arguments for more than one hour was very much interesting.

                                                        

Advocate argued that though the Judgment of Supreme Court gives finality on two points on which this CAT has no authority to take any stand against it, there is another law point that stands open and not negatived by Apex Court. He argued that the GDS service is a government service and there are two Supreme Court judgments clearly say so. The recent judgment of Supreme Court says that any shortfall to pension eligibility service cannot be adjusted from GDS service and that the year of vacancy cannot be taken into consideration. But that judgment did not say that GDS service is not a government service. While any short fall cannot be adjusted for pension qualifying service, the service of GDS itself cannot be dubbed as nongovernmental service. Therefore if promotion to Postman cadre falls later than 1.1.2004, the erstwhile GDS if entered before ,1.1.2004 as a GDS, then he should be brought under CCS Pension system only, provided his total postman service is sufficient for old pension system. This is the argument of Advocate Arun.

Despite the Government pleader repeatedly citing the recent Supreme Court judgment and sought decision in the case, the Judge said that a point of law has come up and hence the decision must be before a Division Bench only. Therefore he set the next argument before a Division Bench on 5.3.2020.

Meeting with Member (P) today .. (18-02-2020)

Today an informal meeting held with Member (P) Shri S.K.Kamila in Directorate. Com. P.Pandurangarao G//S and Com.R.Dhanraj, Dy G/S along with Com.R.N.Parashar, Secretary General, NFPE, Com.Sudheer Mane, Wkg. President, AIPEU GrC (CHQ) participated.

GDS issues viz., GDS Membership Verification, RICT problems, GDS Security enhancement, Voluntary Discharge Scheme etc., were raised. Some important issues related to Gr.C cadre also discussed.

Member (P) responded positively and assured to considered the issues raised by the union representatives.

Meeting held in connection with the Group Medical Insurance Scheme for GDS -- dtd.17-02-2020

A meeting held with NFPE, FNPO & BPEF Secretaries General along with GDS Unions viz., AIPEU-GDS, NUGDS & BPDKS AND  AIGDSU in connection with the implementation of Group Medical Insurance Scheme for GDS.

In continuation of the last meeting held on 17-01-2020, the proposals submitted by OIC & NIC presented with some modifications based on the discussions took place.

On behalf of NFPE, Com. R.N.Parashar, Secretary General, Com. Sudheer Mane, Working President, AIPEU GrC (CHQ), Com. P.Pandurangarao, Genl. Secretary, Com. R.Dhanraj, Dy. Genl. Secretary participated in the meeting. 

After a detailed discussion on the proposals, The OIC & NIC Representatives interacted with Staffside Unions in the presence of  Member (P) along with Senior Officers of the Directorate.

After observing again the merits & demerits of the proposals of OIC & NIC, with in a short period, the process of  implementation of the Scheme could be commenced.
