Dear Comrades,

            As decided by the Federal Secretariat of NFPE, this year’s NFPE Trade Union Study Camps are being organized on 

REGIONAL BASIS. “South Zone Study Camp “

will be conducted at 

CHENNAI 

on 13^th and 14^th October, 2012.

(13.10.2012 & 14.10.2012 Saturday & Sunday). 

Exact venue will be informed shortly. The Camp will commence at 10A.M. on 13.10.2012 and continue up to 5 P.M. on 14.10.2012 Participation of delegates from each Circle Union should be as per the quota shown below:

1.        DELEGATE FEE ::

     DELEGATE IS FIXED AS Rs. 500/- (Rupees Five hundred only)(per one delegate).

2.      Food for two days and Accommodation from 12^th night (for those reaching on 12^th) to 14^th evening will be provided.

3.    Names of the delegates participating from each Circle should be intimated to the Reception Committee by the concerned Circle Secretaries before 20.09.2012. 

        Address and contact number, email ID of the Reception Committee will be intimated shortly.

4.     All General Secretaries are requested to issue instructions to their Circle/Divisional Unions to ensure participation of delegates from each Circle as per the quota shown above.

5.         Delegates may be advised to book their up and down tickets well in advance.

6.         Programme and other details of the Study Camp will be intimated before 20.09.2012.

The duration of training will be 4 days  for EDBPMs  and 3 days for EDDAs who are to attend delivery work. 

The candidate selected for EDBPM post for appointment will be attached to Sub Divisional Inspector for the first two days and for the rest of two days, he will be attached to a Sub Post Office for practical training. 

The candidate selected for other ED posts where the incumbent is required to attend the delivery work will be imparted training before appointment for period of 3 days out of which the first two days, he will be  attached with SDI and the third day he will be attached to a Sub Post Office for practical training.

GDS RULES SHOULD BE MADE STATUTORY ........

The GDS (Conduct & Employment) rules, 2001 are not statutory and were framed under the belief that the ED Agents are not civil servants within the purview of Article 309 of the Constitution of India.

It appears that till about the year 1935, there were no separate set of Rules to regulate the conduct and discipline of ED Agents. In that year the Director General, Post & Telegraphs department framed rules relating to  appointments, penalties and appeals vide DG P&T Circular No.3 dated 16-04-1935.

In the year 1959, however, Extra Departmental Agents were declared as holders of Civil Posts within the purview of Article 309 of the Constitution. Accordingly, in exercise of the powers conferred by the proviso to that Article, statutory rules regulating their appointment and conditions were framed and promulgated on 25-07-1959 vide GSR No.890.

The Department of Posts since 1960 continues to hold the view that the Extra Departmental Agents are not holders of Civil Post even after the land mark judgement of the Hon’ble Supreme Court in Gokulananda Das’s case  decided on 22-04-1977 wherein, it has been categorically held that Extra Departmental Agents are holders of Civil Post.

The Central Administrative Tribunal, Ernakulam Bench rejected the argument of the department put forth before them that the ED Agents have been declared as holders of Civil Post for the purpose of protections and safe guard in Article 311 (2) and observed that :-

“WE FIND NO WARRANT FOR READING THE RESTRICTION IN TO THE DECLARATION OF LAW IN RAJAMMA’S CASE AND LIMITING IT TO ARTICLE – 311, THE DECLARATION IS THAT EXTRA DEPARTMENTAL AGENTS ARE HOLDERS OF CIVIL POST” – (O.A. No.584/95 decided on 23-01-1996)

The position has been further crystallized by the Supreme Court while holding that Extra Departmental Agents are not workmen attracting the provisions of the Industrial Dispute Act, 1947, it has been reiterated that ED Agents are Civil Servants regulated by these Conduct Rules” – (Civil Appeal No.3385-86 of 1966 decided on 02-02-1996)

The repeated attempt to read Article 311(2) in isolation is entirely misconceived and untenable.

ED SYSTEM - VIOLATIVE OF ARTICLES 14 & 16 OF CONSTITUTION OF INDIA

Articles 14 & 16  strike at arbitrariness in State action and ensure fairness and quality of treatment.

Apparently, ED Agents, who get fixed wages without increments, no leave, no pensionary benefits or social security are being discriminated.

As a result of the above discussion, the Extra Departmental Agents have to be included within the overall class of Civil Servants, being holders of Civil Posts.

They can be grouped as "additional" to the departmental employees but they can not be classified as class apart from the Civil Servants. 

At any rate they can not be classified with the sole object of not granting them benefit which accrue to a departmental employee.

The plea taken by the Department before the Second and the Third Pay Commissions and also before the various learned Tribunals that ED Agents are a class apart is entirely misconceived. 

It is violative of Article 14 and 16 of the Constitution .

(3) Suppression of  RPLI premium.

(Rule-51A & 133 of BO Rules)

(4) fraudulent / forgery of SB / RD withdrawal.

(Rules - 134, 144, 143(8) & 136 of BO Rules)

(5) Failure to supervize the work of GDS MD by GDS BPM.

(Rule-9 of BO Rules)

(6) Shortage of Cash.

(Violation of Rule-11 of BO Rules)

(7) Fraudulent payment of Money Orders.

(Rule-121 (2) volume-VI part-III)

(8) Non maintenance of BO accounts.

(Rule-133 of BO Rules)

(9) Loss of Registered articles by GDS MD.

(Rule-86 of BO Rules)

(10)Non opening of BOs

(Rule-5 of BO Rules)

(11)Delay in credit of MS-87(a) by altering.

(Rule-104, 124, 133 & 134 of BO Rules)

(12)Non delivery of unregistered letter by GDSMD.

The above are not exhaustive. 

But if one indulges in any one stated above shall face the trouble.

Directorate has requested the outsourced agency to print 10 lacs OMR kits for sale throughout India through selected Post Offices.

Online application kits will be available in www.indiapost.gov.in from 03.09.12 to 25.09.12 only.Those applied through OMR kits need not apply again.
